Grant of Probate
We offer a fixed fee Grant of Probate service, it’s called Full Estate Administration, and many families use this as it’s a one stop answer to all the complex and difficult things that have to be done when a loved one dies.
Included in our fixed fee is obtaining the Grant of Probate using a Power of Attorney from the nominated Executors, creating any trusts set up in the deceased’s will, producing a final tax return, payment of all outstanding bills or debts, verification of all named beneficiaries and distribution of the estate as directed in the deceased’s will.
There a re a load of benefits to this service compared with many high street Solicitors offer, the most important of which is the fixed fee, once quoted, the estate or the Executors wont be charged any more.
On top of that, the grant is obtained in our name so that the legal responsibility for getting it all right remains with us, did you know that many high street solicitors obtain the grant of probate in the name of the executors, that means that the legal responsibility, the real liability, remains with the executors, so if the Solicitor makes a mistake, it’s the nominated Executor that remains liable for that error.
We also turn up to court to obtain the grant, some Solicitors don’t, and we have the best procedures in place to ensure that all existing debts are paid off correctly and that all potential beneficiaries are located and verified, again, this can sometimes be quite a job!
Also, where possible, we make interim distributions, the full Probate work on an estate can take many months and sometimes debts come out of the blue very late on, however, when we’re confident that most of the debts have been paid and most of the assets have been collected, which can occur in only 2 or 3 months, then we’ll make an interim payment to beneficiaries. The final and complete distribution taking place only when we are certain that the whole estate has been collected and all debts paid.
